INTRODUCTION
This document sets out RadioEU's conditions and Terms of Use for the Magic Notebook service ("Platform", "Service"), education application.

The terms of this document are applicable to all users of Magic Notebook, registered by the versions of the mobile applications.
ACCEPTANCE OF TERMS OF USE
Before you start using Magic Notebook's services, we ask that you read these Terms of Use. By using, accessing or creating an account on the Platform, you certify that you have read, understood and agree to these Terms of Use. It is important that you know that acceptance of these Terms of Use is equivalent to contracting the Service in the exact terms referred to below, which govern the legal relationships between Magic Notebook, as a service provider, and you, as a user. For this reason, we encourage you to read this document until the end. If you do not agree with any of the provisions of this document, you must not use, access, or create an account with Magic Notebook.
It is assumed that you are, capable, over 18 years of age and legally responsible for the children and/or adolescents who will use the platform.
CHANGES TO THE TERMS OF USE
Magic Notebook reserves the right to make changes to the Magic Notebook Terms of Use at any time in case of convenience or need. Changes to the Terms of Use will be communicated by email to all registered users or through a notification the first time you access the Platform after the change. In addition, we present, at the end of this document, the date of the last change. We encourage users to carefully read any notice sent to them regarding changes to our Terms of Use. Continuing to use the services offered by Magic Notebook after the alteration and publication on the website constitutes implicit acceptance of the new Terms of Use. We remind you that you have the right to stop using or accessing the Platform at any time you wish.
DESCRIPTION OF THE PLATFORM
Magic Notebook is a service that contains content and services for Android operating systems from versions 4.4 onwards, for Apple cell phones and tablets (iOS 8.0 or later) and the following browsers: Internet Explorer 10+, Mozilla Firefox 16+, Google Chrome 20+, Safari 5+, Microsoft Edge, Opera 33+.
INTELLECTUAL PROPERTY RIGHTS
Only you may access the Service using your telephone number. The Service (including, but not limited to, the Content) is owned by Magic Notebook or its licensors and is protected by copyright or other intellectual property laws. The Service may only be used for personal, non-commercial purposes. You agree not to (i) reproduce, record, rebroadcast, redistribute, disseminate, sell, rent, lease, broadcast, publicly disclose, adapt, sublicense or circulate any Content received through the Service to any third party, (ii) exploit such Content for commercial purposes without Magic Notebook's express prior written consent, or (iii) share your password with any third party. You may not make unauthorized copies of Content obtained through the Service, and you may only make such copies as reasonably necessary for your personal, non-commercial use. Since the Service is designed for your personal use, you are not permitted to use any automated system for the selection or transmission of files. You also agree to compensate Magic Notebook for your failure to comply with this section. Magic Notebook and its licensors retain exclusive ownership of the Content, the Service and all intellectual property rights associated therewith. Except as expressly provided in this Agreement, you are not granted any rights or licenses to patents, copyrights, trade secrets or trademarks with respect to the Service or its content. Magic Notebook and its licensors reserve all rights not expressly granted in this Agreement. You must notify Magic Notebook immediately in writing as soon as you discover any unauthorized use or infringement of the Service (its content) or any patent, copyright, trade secret, trademark or intellectual property rights of Magic Notebook or its licensors. The Service contains proprietary information that is protected by copyright laws and international treaty provisions. Magic Notebook expressly disclaims any and all liability for any action you take that is contrary to these laws and reserves the right to terminate your Service immediately for your failure to comply with any local, state or federal law.
COPYRIGHT INFRINGEMENT
It is Magic Notebook's policy to respect the intellectual property rights of its artists and content providers. If you are a copyright holder and believe that Magic Notebook or its Service is directly hosting or linking to copies that infringe your work, please let us know. Notification of alleged copyright infringement must be sent to Magic Notebook's designated copyright agent at the following address: Av. Cidade Jardim, 400 – São Paulo – SP

A notice of alleged copyright infringement must be addressed to the Magic Notebook copyright agent listed above and include the following:
A physical or electronic signature of the owner (or authorized person) to act on behalf of the owner) of the allegedly infringed copyright;
Specific identification of each copyrighted and allegedly infringed work;
A description of where the material believed to have been infringed is located on the Magic Notebook website (eg hyperlink);
Claimant's contact information, such as full name, address, telephone number and email address;
A statement that the complaining party honestly believes that use of the works in the manner stated is not authorized by the copyright owner, its agent, or the law;
A statement that the notice information is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
SHARING INFORMATION WITH THIRD PARTIES
Magic Notebook does not use your Personal Information for purposes incompatible with those listed in this Privacy Policy or in any specific privacy notice we may provide to you when collecting your Personal Information.
In some cases, access to certain products and services, such as content subscription products or products distributed by third parties, may require you to provide Personal Information to a third party such as a content provider, ad network or distributor. Magic Notebook may also receive your Personal Information from third-party service partners and advertisers in an effort to facilitate the personalization of your content preferences. The third party's use of this information is governed by the third party's privacy policy, and Magic Notebook's use is governed by this privacy policy. Please review the content partner's privacy policy to make sure you understand how they use the Personal Information you provide them. MANDATORY OR OPTIONAL NATURE OF REQUESTED INFORMATION
In certain instances, we may offer you the option to select whether you would like to receive information from us or trusted third parties (e.g. opting in or opting out of receiving special promotional offers). In some circumstances you will not have the option to opt out, for example if we are performing the obligations of a contract, administering a transaction requested by you or as required by law or government authorities.

Magic Notebook is not responsible for and makes no express or implied warranty with respect to or about the accuracy and reliability of the services, products and other goods advertised by third parties on the Platform; content posted by users; and Linked Services (collectively, Third Party Content).
About Third Party Content: (i) Does not necessarily reflect the views or policy of Magic Notebook; (ii) May contain links to other Websites or services and Magic Notebook is not responsible for the Content, accuracy or opinions expressed on such Websites and services, and the accuracy and completeness of such Websites and services are not necessarily investigated, monitored or verified by Magic Notebook ; (iii) The inclusion of any linked website or service on the Magic Notebook Services does not imply approval or endorsement thereof. When you access these third party sites and services, you do so at your own risk; (iv) Magic Notebook assumes no responsibility for Third Party Content that is posted on, by or in association with the Magic Notebook Services, nor does it assume any responsibility for the goods or services provided by such third parties.
Magic Notebook is not responsible for the conduct, both online and offline, of any User of the Magic Notebook Services or linked services.
Magic Notebook is not responsible for any problems or technical malfunctions of any telephone network or lines, online computer systems, servers or providers, computer equipment, hardware and software due to technical problems or traffic congestion on the Internet or any of the Services. of Magic Notebook or Linked Services or a combination thereof, including, without limitation, any damage or injury to Users or any person's computer related to or resulting from participation in relation to the Magic Notebook Services or Linked Services.

Under no circumstances will Magic Notebook be liable for any loss or damage, including, without limitation, injury or death, resulting from the use of the Magic Notebook Services or linked services, from any Third Party Content posted on or through the Magic Notebook Services.
Magic Notebook Services or linked services are offered "AS IS" and as available, and Magic Notebook expressly disclaims any warranty of fitness for a particular purpose. Magic Notebook cannot guarantee and does not promise any specific results from using the Magic Notebook Services or Third Party Content. Like any other service provided over the internet, the functionality of our Service depends on the quality of service provided by third parties.
We cannot compromise with the quality and stability of the linked services, provided by third parties, such as internet providers, telephone companies, servers and the like. Nor can we be responsible for any loss of data by remote servers, over which we have no interference, therefore we advise that users who have uploaded material to the Platform, always keep the original files on their computers.
IN NO EVENT SHALL MAGIC NOTEBOOK BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS DAMAGES RESULTING FROM YOUR USE OF THE Magic Notebook SERVICES OR LINKED SERVICES, WHETHER MAGIC NOTEBOOK HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANY PROVISION TO THE CONTRARY CONTAINED HEREIN, MAGIC NOTEBOOK'S LIABILITY TO YOU FOR WHATEVER CAUSE AND REGARDLESS OF THE FORM OF THE ACTION, SHALL ALWAYS BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO MAGIC NOTEBOOK DURING THE TERM OF MEMBERSHIP.
Finally, we are not responsible for transactions carried out between our users and business partners, even as a result of advertising or advertisements displayed on our website. 5. Is there data consumption?
With internet access, there may be data consumption according to the tariff of your plan.
6. What is the Magic Notebook?
Magic Notebook is a Mathematics teaching service, aimed at Preschool and Elementary I (5th grade) children. There are more than 30,000 exercises, according to the official Brazilian curriculum. Learning math is easier and more fun with the Magic Notebook!
7. What is the subscription fee for Magic Notebook?
The service costs R$4.99/week or R$14.99/month. You can choose the mode you prefer. By subscribing to any of the modalities, you get 1 day free! If there is not enough balance in the renewal of the weekly rate, the charge may be partial. In this case, the amount of credits and days of access to html5 games will be proportional to the days charged. 8. Who can sign the Magic Notebook?
To subscribe, all you need is a Vivo pre, post or control line. You can also subscribe through Google and Apple stores.
9. How do I subscribe to Magic Notebook?
For weekly subscription (R$4.99/week), send an SMS with the word CMS to the number 18180. For the monthly subscription (R$14.99/month), send an SMS with the word CMM to 18180.
10. After the subscription, how soon can I start using the service?
Confirmation of subscription to the service will be sent by SMS. After this confirmation, which occurs immediately, you are ready to use the service and learn Mathematics while playing!
11. Will my subscription renew automatically?
Yes, subscription renewal happens automatically at the end of each period. If you no longer want to subscribe to the service, you must cancel.
12. Can I access Magic Notebook on which devices?

14. Does the service only work over the Internet?
Is offline access possible? The service works over the Internet only.
15. How can I cancel the service?
You can cancel the service in 3 ways: • Via SMS: sending the word SAIR or CANCELAR to the number 18180 • Via WEB (www.cadernomagico.com.br: “Cancel Subscription” option • Via APP: “Cancel Subscription” option
16 If I cancel, do I lose access to the service immediately?
When canceling, your subscription and access to the service are available until the end of the contracted period. Example: - Weekly Subscription: you subscribed on 01/01/19 for R$4, 99/week, but canceled the following day (01/02/19).
